1 · Who you are agreeing with
These terms are an agreement between you and 10,000 Trials, a sole proprietorship registered in Solano County, California, which also does business as Algomist Labs and is the company behind this site and its products, including The Distillate. In this document, "we" and "us" mean 10,000 Trials, and "you" means the person who bought the license.
You accept these terms when you buy, download, install, or use the software. If you do not accept them, do not use it, and ask for a refund under section 10.
2 · What the software does
The Distillate connects to your brokerage account and can place real orders with real money. This is the most important thing on this page. It is not a chart indicator and it is not a simulation.
Specifically, the software:
- runs on your own computer or server, not ours;
- connects to your own Interactive Brokers account using credentials you control;
- calculates a target exposure each day from a published rule, using market data;
- reports what it would do, and places nothing until you explicitly arm it;
- once armed, places real buy and sell orders in your account, on its schedule, without asking you again.
We never take custody of your money, never hold your funds, never have access to your brokerage account, and never trade on your behalf. Every order is placed by software running on your machine, under your control, in your account, after you turned it on.
In plain terms: you own the account, you flip the switch, and you carry the outcome.
3 · This is not investment advice
Nothing we provide — the software, this website, the documentation, backtests, the live track record, Discord messages, or any other communication — is financial advice, investment advice, or a recommendation to buy or sell anything.
We are not a registered investment adviser, broker-dealer, commodity trading advisor, or financial planner, and we hold no professional licenses in those fields. We do not manage anyone's account, we do not take a share of anyone's profits, and we do not give individual recommendations about what you personally should do with your money.
The software is a tool that executes a rule you choose to enable. Deciding whether that rule is appropriate for you is your decision, and it is a decision you should consider taking to a qualified professional who knows your situation.
4 · No guarantee of results
Backtested performance is not a promise. It is one sample of history, computed after the fact, and the future is under no obligation to resemble it. The live track record is short and may stay disappointing for a long time.
Trading involves substantial risk of loss and is not suitable for everyone. You should assume that:
- you can lose money, including a large part of the money you put in;
- the strategy will have long stretches where it underperforms simply holding an index;
- its worst historical drawdown was severe, and the next one could be worse;
- leverage, where the strategy uses it, amplifies losses as well as gains.
We publish the drawdowns and the failures on purpose. Please read them before you arm anything.
5 · What you are responsible for
Because the software runs on your machine and in your account, a number of things are yours to manage:
- Your broker account — opening it, funding it, its permissions, its margin status, and any Pattern Day Trader restrictions that may cause your broker to reject orders.
- Your machine — keeping it powered and awake at the scheduled time. A laptop that goes to sleep is a program that quietly stops trading.
- Monitoring — checking that it is running and that what it did matches what you expected. It reports; it is your job to read the reports.
- Deciding to arm it — and deciding to disarm it, which you can do at any time.
- Your own taxes — every trade it places is a taxable event in your account, and we do not provide tax advice or reporting.
Software fails. Networks drop. Brokers change their APIs and reject orders. Data feeds return bad numbers. The software may place an order you did not expect, or fail to place one you did. Treat it as something to supervise, not something to forget about.
6 · Your license
When you buy a license, we grant you a perpetual, personal, non-exclusive, non-transferable license to install and use the software for your own trading, on machines you control, in brokerage accounts you own.
Perpetual means we cannot take it back from you if you keep to these terms. You are buying a license to use the software, not the software itself; we keep ownership of it and of everything in it.
7 · What you may not do
- Redistribute, resell, publish, lend, or share the software or your copy of it.
- Use it to trade accounts belonging to other people, or to operate a service for others.
- Share your license, your download, or your companion access with anyone else.
- Reverse-engineer or decompile it, except where the law says you may regardless of this clause.
- Remove or obscure any notice of ownership in the files.
We will be straightforward about enforcement: the software is a file on your computer, and we cannot take a file back. What we can and will withdraw is your access to the TradingView companion and to future updates and support. That is the practical consequence of sharing it.
8 · The TradingView companion
The chart companion is published on TradingView on an invite-only basis with its source hidden. Access is granted to your TradingView username and is tied to your license.
Access to the companion depends on TradingView remaining available and on their terms, which are outside our control. If the companion becomes unavailable through no fault of ours, that does not entitle you to a refund of the license, which is for the software.
9 · Updates
Your license includes updates to the software for as long as we continue to publish them, at no extra charge. This is what we mean by "lifetime updates" on the website: the lifetime of the product, not a guarantee about your lifetime or ours.
We may change how the software works, including the strategy it implements, when our research finds something better or finds that something we shipped was wrong. We may also stop publishing updates entirely. If we do, the version you already have keeps working and remains yours to use.
10 · Refunds
Refundable in full until you download the software or accept the repository invitation, whichever comes first. After you buy a license we email you a private download link, and, if you ask for it, an invitation to the software repository. Both sit unused until you act on them, and for as long as they do, one email to support@algomistlabs.io gets you a full refund. You do not have to explain yourself and we will not argue with you about it.
The first download, or accepting the invitation, is delivery, and it closes the refund window. At that moment you have the software, and software cannot be recalled. We would rather state that plainly before you buy than advertise a refund we have no way of honouring. Our server records the first download of your link and GitHub records whether an invitation is pending or accepted; those records are what we go by.
By downloading the software or accepting the invitation you are asking for immediate delivery of digital content and acknowledging that doing so ends any statutory right of withdrawal you would otherwise have.
You do not need a refund in order to evaluate the software. It ships in dry-run and stays there until you deliberately arm it. You can point it at your own brokerage account, leave it unarmed, and have it report what it would have done for as long as you like without placing a single order. That is the trial, it is open-ended, and it does not require you to have decided anything.
Three things this policy is not:
- It is not performance-based. Trading losses are never grounds for a refund. The evaluation period exists so you can decide whether the software is for you, not so you can test whether the market cooperated.
- It is not a restocking fee. Before delivery you get all of your money back, not part of it.
- It is not a subscription. There is nothing recurring to cancel. You paid once.
If something in the software genuinely does not work as described and we cannot fix it, write to us anyway. This section sets out what you are entitled to, not the limit of what we are willing to do about our own defects.
Concierge installation is different, because it is time rather than software. You can cancel and be refunded in full at any point before your session takes place. Once the session has happened, it is not refundable. Where concierge is bought bundled with a license, the license half follows the rule above and the concierge half follows this one.
Expansions (such as BTC + AU) are included with the license at no extra cost as each clears its gate; the license’s refund rule covers them. That first download is delivery and closes the refund window. An expansion can later be switched off or withdrawn if it fails a test we have published; that is not grounds for a refund. You keep the file, and switching an expansion off sells only the shares it bought, never yours and never the engine’s. The Distillate’s built-in basket tool, and the presets that come with it, are part of the license and follow the license’s rule.
Refunds are processed manually and go back to the card you paid with. Allow a few business days for your bank to show it.
11 · No warranty
The software is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the software will be uninterrupted, error-free, or free of defects, that it will connect to your broker successfully, that market data it receives will be accurate, that any order will be placed or filled, or that using it will be profitable.
12 · Limit of liability
To the fullest extent the law allows, our total liability to you for any claim arising out of the software or these terms is limited to the amount you actually paid us in the twelve months before the claim.
We are not liable for trading losses, lost profits, missed opportunities, lost data, or any indirect, incidental, special, or consequential damages — including where those arise from orders the software placed, orders it failed to place, or the software not running at all.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability for fraud or for anything else that cannot lawfully be limited.
13 · Ending this agreement
You can stop using the software at any time. Disarming it stops it trading immediately; deleting it removes it entirely.
If you breach these terms — most realistically by sharing or reselling the software — we may withdraw your access to the TradingView companion, to updates, and to support. Sections 3, 4, 5, 11, and 12 survive the end of this agreement.
14 · Changes to these terms
We may update these terms. If we make a change that materially affects your rights, we will change the date at the top and, where we have your email from a purchase, tell you. Changes are not retroactive: the version in force when you bought governs that purchase.
15 · Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in California, and you and we each consent to that jurisdiction.
If any part of these terms is found unenforceable, the rest stays in force.
